A Franklin County driver will not face charges in the death of a pedestrian on Ga. 59 in Banks County Tuesday night.
Andrew Kelly, 28, of Carnesville was driving south on Ga. 59 in a 2008 Ford Focus when a pedestrian entered the roadway from the eastbound shoulder, according to Cpl. Joshua Hedden of Georgia State Patrol Post 6 in Gainesville. Hedden said the right front bumper of Kelly's vehicle hit 39-year-old Katarzyna Stapor.
Stapor, of Roswell, was fatally injured upon being struck, according to the Georgia State Patrol
The pedestrian was not in a crosswalk and was not wearing reflective clothing, Hedden said, adding no charges will be filed.
The accident happened at approximately 8:12 p.m. near Walkers Way. The State Patrol says Stapor was not in a crosswalk when she attempted to cross Ga. 59 and she was not wearing reflective clothing.
